Road Cycle Rentals — Kerala
Master Rental Terms & Conditions
This is a one-time agreement signed by every customer at the time of first registration. It applies to every subsequent rental transaction made by the Renter with Rent Your Adventure, each of which is recorded on a Rental Transaction Slip referencing this document.
For booking changes and refund timelines, please review our Cancellation Policy.
1. Renter Identification
The Renter must provide a valid government-issued photo ID (Driving Licence / Passport / Aadhaar / Voter ID). A copy is retained for verification purposes. The Renter must also provide a local reference contact (name and phone number of a person residing in the same city/district, not the Renter's own number) and a local residential address, which the Company may verify before handover. Renters under 18 must be accompanied by a parent/guardian who co-signs this Agreement.
2. Data Privacy
ID and contact details collected are used only for identity verification, security, and legal compliance, in line with the Digital Personal Data Protection Act, 2023, and will not be shared with third parties except law enforcement where legally required.
3. Inspection
Every cycle and its accessories are jointly inspected and documented (in writing / photographs) at the start and end of each rental. This includes a manual physical examination of the cycle's frame, brakes, gears, tyres, chain, and accessories by the Company's staff and the Renter together before handover, to record its condition and avoid future disputes. Any new damage or missing item found at return will be charged as per Clause 7.
4. Rental Fees & Security Deposit
Fees and deposit amount for each rental are recorded on the Transaction Slip. The deposit is refundable after deductions, if any, for damage, loss, or late return.
5. Return & Late Fees
Cycles must be returned by the date/time noted on the Transaction Slip. Late returns attract additional charges as communicated at the time of booking. Cycles not returned within a reasonable grace period without notice will be treated as lost, and recovery of the full declared value will be pursued.
6. GPS Tracking
Cycles may be fitted with a GPS tracking device for theft prevention and recovery. By signing this Agreement, the Renter acknowledges and consents to this, and agrees that location data will be accessed by the Company only for security and recovery purposes.
7. Damage, Loss & Theft
The Renter is responsible for any loss, theft, or damage beyond normal wear and tear. In case of theft, the Renter must file a police complaint (FIR) within 24 hours and share a copy with the Company. Repair/replacement cost is first deducted from the deposit; any shortfall is payable by the Renter.
8. Breakdown
For mechanical issues not caused by Renter negligence — such as brake or gear cable failure under normal use, chain or derailleur faults, tyre punctures from normal riding, bearing or bracket wear, or any other manufacturing or pre-existing mechanical defect present at the time of handover — the Company will arrange repair or replacement at its own cost. Issues NOT covered under this clause, and for which the cost is borne by the Renter, include damage from collision or a fall, riding on unsuitable/off-road terrain, overloading the cycle, improper gear shifting or forced pedaling, failure to lock/secure the cycle when unattended, damage caused while under the influence of alcohol or intoxicants, or any other issue arising from negligence, misuse, or violation of Clause 10. Notwithstanding the above, in case of any noticeable risk factor, mechanical issue, or systemic defect in the cycle, the Renter shall immediately inform the Company, this being the Renter's duty under this Agreement.
9. Helmet & Safety Gear
A helmet is provided with every rental. Riding without using provided safety gear is entirely at the Renter's own risk.
10. Prohibited Use
The cycle may not be used for illegal activity, sub-let or lent to any third party, ridden by anyone other than the named Renter, used on unsuitable terrain, used for racing/stunts without written permission, or ridden under the influence of alcohol or intoxicants. GPS trackers or safety components must not be tampered with.
11. Geographic Restriction
Cycles may only be used within the district(s)/route(s) permitted at the time of booking. Multi-day tours or travel outside the permitted area require prior written approval.
12. Liability Waiver & Assumption of Risk
The Renter voluntarily assumes full responsibility for injury, accident, or loss arising from their own actions, including reckless riding, non-use of safety gear, or violation of Clause 10. If the Renter meets with any accident, injury, or other issue while using the cycle, the Company shall not be liable for the same, except where such issue arises from the Company's own gross negligence or from supplying a defective/unsafe cycle. The Company confirms every cycle is inspected and safe prior to handover. The Renter shall indemnify and compensate the Company in full for any damage caused to the cycle or accessories during the rental period, as assessed under Clause 7. Further, the Company shall not be liable for any third-party claim or liability arising from the use of the cycle rented, and the Renter shall keep the Company indemnified in respect of any liability or loss arising out of the use of the cycle rented.
13. Insurance
The Company does NOT carry insurance covering theft, accidental damage, or third-party liability for the cycle or accessories. The Renter is encouraged to arrange personal accident/health insurance for the rental duration. The security deposit and declared value of the cycle serve as the basis for recovering costs under Clause 7.
14. Force Majeure
Neither party is liable for delay or non-performance caused by events beyond reasonable control, including natural disasters, extreme weather, strikes/hartals, or government restrictions.
15. Jurisdiction & Disputes
This Agreement is governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts at Ernakulam, Kerala. Parties will first attempt amicable resolution through discussion.
